Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Track Record mobile application and website (the "Service"), operated by TrackRecord LLC ("Track Record," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and Accounts

The Service is intended for use by coaches and their athletes.

Coaches must be at least 18 years old to create a coach account.

Athletes may be added to a team roster by a coach, or may join directly via an invite or team link. Athletes under the age of 18 should only be added or invited with appropriate involvement of a parent, guardian, or coach acting within their coaching role. Additional consent requirements for athletes under 13 are described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. The Service

Track Record allows coaches to record and review athlete video, log results, track progress over time, and communicate with athletes through comments. Athletes have a separate, more limited view of the Service focused on viewing their own content and communicating with their coach.

3. Subscriptions and Billing

Certain features of the Service require a paid subscription ("Plan"). Available Plans and their features are described within the app and are subject to change.

Free trial. New subscriptions may include a free trial period, as described at the time of purchase. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged according to the Plan and billing interval you selected.

Billing. Subscriptions are billed through Apple's In-App Purchase system and are subject to Apple's own terms and payment processing. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

Cancellation. You may cancel your subscription at any time through your Apple ID account settings. Canceling stops future charges but does not refund amounts already paid, except as required by law or Apple's refund policies.

Plan limits. Each Plan includes specific limits (such as athlete roster size or coach seats) as described in the app. Continued use of features beyond what your current Plan allows may require an upgrade.

4. User Content

Your content. "Content" includes video, photos, comments, results, and other material uploaded or created through the Service.

Ownership. As between you and Track Record, you retain ownership of Content you upload. Coaches and teams retain rights to video and session content created as part of their coaching activity. Athletes are granted access to view Content shared with them and, where enabled, to comment on it.

License to us. You grant Track Record a limited license to store, process, and display your Content solely as necessary to operate the Service.

Responsibility for content. You are responsible for Content you upload and for ensuring you have the right to share it, including any necessary consent from athletes or their parents/guardians.

5. Acceptable Use

You agree not to use the Service to:

• Upload content you do not have the right to share
• Harass, abuse, or harm another user
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service in a way that violates applicable law

We reserve the right to remove content or suspend accounts that violate these Terms.

6. Account Deletion

You may delete your account at any time through the Settings screen in the app. Deleting your account removes your associated data as described in our Privacy Policy. Deleting your account does not automatically cancel an active Apple subscription — subscriptions must be canceled separately through your Apple ID account settings to avoid future charges.

7. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or that video/data will never be lost, though we take reasonable measures to protect stored content.

8. Limitation of Liability

To the maximum extent permitted by law, TrackRecord LLC and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and delete your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify users through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the state in which TrackRecord LLC is formed, without regard to conflict of law principles.
